Terms of Service

bijnis.xyz offers the following plans. Plan pricing is shown on the pricing page and confirmed at the time of purchase; applicable taxes are added as described in the Fees and Payment section.

• Free Plan: A full-quality business website built with AI — including a choice of 50+ ready-made templates, an AI-generated business catalog, AI-generated images and banners, logo generation, free hosting on a bijnis.xyz subdomain, mobile-optimized design, SSL, and click-to-chat — provided at no cost, with the website published live. Excludes Google Business Profile optimization, WhatsApp automation, and custom domains.
• Seed Plan: Complete WhatsApp automation (auto-replies, inbox, broadcasts), complete Google Business Profile setup, GBP optimization & keywords, local SEO targeting, a review request link, automated AI replies to your Google reviews, and automated negative & spam review detection with instant alerts.
• Sapling Plan: All Seed features plus automated social posting across Google and Facebook (6 AI-optimized posts per week, per platform), AI-optimized replies to every message on Facebook and Instagram and to comments on Facebook, a business performance dashboard showing your progress and ROI (updated twice a week), and a 90-day top-5 ranking guarantee.
• Tree Plan: All Sapling features plus multi-location Google Business Profile management, advanced AI SEO & GEO campaigns, monthly competitor analysis, a one-time NAP consistency audit report, an AI sales agent on WhatsApp that captures leads, collects payments and books appointments, AI sales agents on Facebook and Instagram that detect and capture leads, and advanced AI-based system support available 24/7. The Tree Plan is available on self-serve checkout at the price shown on the pricing page.

Custom Website Build (one-time project). A bespoke, custom-built website designed to your brand and specification is not part of any plan and is offered separately as a one-time, quoted project, billed once. Scope, design, revision count, and price are confirmed in writing before work begins, and work starts only once you approve the written quote. Anything not expressly listed as included in that written scope is out of scope unless separately agreed in writing. Timelines depend on how quickly you provide content and approvals, and your domain and hosting must remain active in your name for the website to stay live. You are solely responsible for purchasing and renewing any custom domain; bijnis.xyz does not register, sell, renew, or charge for domains, and is not responsible for any website unavailability caused by an expired, lapsed, or misconfigured custom domain.

WhatsApp Business automation features — including automated welcome messages, review collection, appointment reminders, contact management, and broadcast campaigns — are available as part of applicable plans or as an add-on. Use of WhatsApp features is subject to Section 4 of these Terms and Meta's platform policies.

Facebook and Instagram social media management features — including catalog-to-post publishing, AI content scheduling, Reel and Story creation, comment and DM automation, catalog sync to Instagram Shopping and Facebook Shops, and social performance analytics — are available as part of applicable plans or as an add-on. Use of Facebook and Instagram features is subject to Section 4A of these Terms.

YouTube channel management features — including video and Shorts publishing, Community Post scheduling, comment management, and YouTube analytics — are available as part of applicable plans or as an add-on. Use of YouTube features is subject to Section 4B of these Terms.

All prices are as stated on the relevant plan page at the time of purchase.

We reserve the right to modify service features or pricing with 30 days' notice to existing subscribers.

• You must provide accurate, current, and complete information during onboarding.
• You are responsible for maintaining the confidentiality of any login credentials we provide.
• You must promptly notify us of any unauthorized access to your account.
• You may not share your account or allow third parties to use our services on your behalf without our written consent.
• You represent that you are at least 18 years of age and have the legal authority to enter into this agreement on behalf of your business.
• You are responsible for ensuring that all business information, content, approvals, and instructions provided to us are lawful, accurate, and up to date.

Some bijnis.xyz services require access to Google services through Google OAuth and related Google APIs, including the Google Business Profile API.

By connecting your Google account or authorizing bijnis.xyz to act on your behalf, you expressly authorize us to access, retrieve, use, display, update, and manage relevant Google Business Profile data strictly as necessary to provide the services you have subscribed to.

This may include access to and management of:

• Google Business Profile account and location information;
• business name, address, phone number, website, business hours, categories, and attributes;
• photos, posts, products, services, and related listing content;
• reviews and review responses;
• performance insights and profile-related analytics; and
• other Google Business Profile data reasonably required to deliver subscribed services.

We will request only the permissions and OAuth scopes reasonably necessary to deliver the features you enable or purchase.

3.1 Customer Authorization

You represent and warrant that:

• you are the lawful owner of the Google account or Google Business Profile you connect, or
• you have full authority from the business owner or organization to authorize bijnis.xyz to access and manage such assets on its behalf.

You retain ownership of your Google account, Google Business Profile, and underlying business data, subject to Google's own rights and platform rules.

3.2 Revocation of Access

You may revoke bijnis.xyz's access to your Google account or connected Google Business Profile at any time through your Google account permissions or by contacting us at hello@sotlabs.net.

If you revoke access, some or all of our services may stop functioning, and we will not be responsible for any resulting interruption, reduced performance, or inability to continue managing your Business Profile.

3.3 Third-Party Platform Dependency

Our services depend in part on Google systems, APIs, verification workflows, moderation processes, platform features, and policies. We do not control Google's decisions regarding verification, suspension, reinstatement, rankings, API access, content moderation, or continued availability of any feature.

bijnis.xyz provides WhatsApp Business automation features as a WhatsApp Business Solution Provider (Tech Provider) under Meta's WhatsApp Business Platform. By enabling WhatsApp integration features on our platform, you agree to the terms in this section, Meta's Business Terms of Service, and the WhatsApp Business Messaging Policy.

4.1 Customer Opt-In Requirement

You are solely responsible for obtaining valid, explicit opt-in consent from your end customers before sending them any WhatsApp messages through our platform. Valid opt-in means the end customer has clearly agreed to receive WhatsApp communications from your business, either by:

• initiating a conversation with your WhatsApp Business number (customer-first contact); or
• providing explicit written or digital consent through a form, physical register, or other mechanism that clearly describes the type and frequency of messages they will receive.

You must maintain records of opt-in consent and provide them to bijnis.xyz or Meta upon reasonable request. You must not send messages to contacts who have not provided valid opt-in consent or who have previously opted out.

4.2 Prohibited Messaging Uses

You agree not to use bijnis.xyz's WhatsApp integration to:

• send unsolicited messages (spam) to any contact who has not provided valid opt-in consent;
• send messages promoting or facilitating illegal activities, adult or explicit content, weapons, drugs, tobacco, alcohol to minors, gambling, counterfeit goods, or any content prohibited under WhatsApp's Business Messaging Policy;
• send misleading, deceptive, or fraudulent messages;
• impersonate another business, brand, or individual;
• scrape, purchase, or harvest phone numbers for unsolicited outreach;
• send political campaign messages or solicit votes;
• send messages at frequencies that constitute harassment;
• send content that infringes any intellectual property, privacy, or other legal right; or
• use our platform in any way that violates Meta's Business Terms of Service, WhatsApp's Business Messaging Policy, or applicable Indian or international law.

4.3 Meta Policy Compliance

By using our WhatsApp integration features, you agree to comply with and be bound by the following policies, as updated by Meta from time to time:

• WhatsApp Business Messaging Policy
• Meta Business Terms of Service
• Meta Platform Terms

It is your responsibility to remain informed of and compliant with the current versions of these policies. bijnis.xyz is not responsible for changes to Meta's policies that affect your ability to use WhatsApp features.

4.4 Meta's Right to Suspend or Ban Numbers

Meta Platforms, Inc. independently enforces its platform policies and reserves the right to suspend, restrict, or permanently ban any WhatsApp Business number or WhatsApp Business Account at its sole discretion, without notice to bijnis.xyz. bijnis.xyz has no control over Meta's enforcement decisions and accepts no liability for any suspension, restriction, or permanent ban of your WhatsApp Business number or account by Meta.

You bear full responsibility for any enforcement action taken by Meta resulting from your messaging content, practices, or violation of Meta's policies. Any resulting loss of access to WhatsApp features, contacts, or message history is your liability and not that of bijnis.xyz.

4.5 Opt-Out and Unsubscribe Compliance

You must honor all opt-out requests from your end customers promptly and without exception. Our platform automatically processes STOP and OPTOUT replies and flags the relevant contact as opted out. You must not attempt to re-add opted-out contacts to messaging lists, contact them through alternative numbers, or otherwise circumvent opt-out requests.

4.6 bijnis.xyz's Right to Suspend WhatsApp Services

bijnis.xyz reserves the right to immediately suspend or permanently terminate your access to WhatsApp integration features, without prior notice or refund, if:

• we receive a complaint, policy violation notice, or enforcement action from Meta regarding your WhatsApp number or account;
• your messaging quality rating on Meta's platform falls below acceptable thresholds;
• we determine in our reasonable judgment that your use violates Section 4.2 or any applicable Meta policy; or
• your WhatsApp number or account is suspended, restricted, or banned by Meta.

4.7 Your Responsibility as Data Controller

You are the data controller for your end customers' personal data processed through our WhatsApp integration. You are responsible for ensuring that your data collection, messaging, and storage practices comply with applicable data protection laws, including India's Digital Personal Data Protection Act, 2023.

You must provide your end customers with clear, accessible information about how their data will be used for WhatsApp communications and maintain a simple, functional opt-out mechanism.

4.8 WhatsApp Integration Disclaimer

WhatsApp automation features depend on Meta's WhatsApp Business Platform, API availability, number quality ratings, and Meta's ongoing approval of bijnis.xyz as a Tech Provider. bijnis.xyz does not guarantee continuous availability of WhatsApp features and is not liable for service interruptions caused by Meta's platform, policy changes, or enforcement actions outside our control.

4.9 Customer-Owned WhatsApp Business Account Required

To activate WhatsApp Business automation features, you must provide bijnis.xyz with API access to a WhatsApp Business Account (WABA) that is registered in your name or your business's name and approved by Meta. bijnis.xyz does not create, own, supply, or operate a shared WABA on your behalf.

You are responsible for:

• registering and maintaining a valid, approved WABA with Meta in compliance with Meta's requirements;
• ensuring your WABA remains in good standing, compliant with Meta's Business Terms of Service, and eligible to use the WhatsApp Business API;
• any action or inaction on your WABA that results in its suspension, restriction, or termination by Meta; and
• managing and revoking bijnis.xyz's access to your WABA through Meta's Business Manager at any time.

bijnis.xyz will connect to your WABA solely to configure and operate the automation features included in your plan. We will not use your WABA for any purpose beyond delivering those services.

4.10 WhatsApp API Usage Charges

WhatsApp Business API usage generates per-conversation charges that are billed directly by Meta Platforms, Inc. to the payment method registered in your Meta Business Manager account. These charges are entirely separate from and in addition to your bijnis.xyz subscription fee.

You are solely responsible for all WhatsApp API conversation charges, message fees, template fees, and any other amounts billed by Meta to your WABA, regardless of whether the usage was initiated by bijnis.xyz's automation features acting on your instruction.

bijnis.xyz does not invoice, collect, absorb, pass through, or reimburse any Meta-billed WhatsApp API charges. You should monitor your WhatsApp API usage and billing directly in Meta Business Manager and set appropriate billing limits before activating automation features. For Meta's current WhatsApp API pricing, refer to Meta's official documentation at business.whatsapp.com/products/platform-pricing.

bijnis.xyz provides Facebook Page and Instagram management features as an approved Meta Tech Provider. By enabling Facebook or Instagram integration features on our platform, you agree to the terms in this section, Meta's Business Terms of Service, Meta's Platform Terms, and Meta's Developer Policies.

4A.1 Customer Authorization

By connecting your Facebook Page or Instagram account to bijnis.xyz, you represent and warrant that:

• you are the lawful owner or authorized administrator of the Facebook Page and Instagram account you connect;
• you have full authority to authorize bijnis.xyz to access, publish content to, read data from, and manage engagement on that Page and account on your behalf; and
• your use of bijnis.xyz's social features will comply with Meta's Business Terms of Service, Meta's Platform Terms, Instagram's Community Guidelines, and Facebook's Community Standards.

4A.2 Acceptable Use — Content Publishing

You agree not to use bijnis.xyz's Facebook and Instagram publishing features to post:

• content that violates Meta's Community Standards, Instagram's Community Guidelines, or applicable Indian or international law;
• false, misleading, or deceptive claims about products, services, prices, or your business;
• content promoting illegal activities, adult or explicit content, weapons, drugs, tobacco products to minors, gambling, counterfeit goods, or any category prohibited under Meta's Advertising or Commerce Policies;
• content that infringes the intellectual property, privacy, or other legal rights of any third party;
• spam, repetitive, or low-quality bulk content designed to game algorithmic reach; or
• political campaign content, voter solicitation, or election-related messaging.

4A.3 DM and Comment Automation

You may configure automated responses to Instagram Direct Messages and Facebook Page messages and comments through our platform. You agree that all automated responses you configure:

• are accurate, non-deceptive, and represent your business truthfully;
• comply with Meta's Messaging Policies and applicable consumer protection law;
• include a clear mechanism for end customers to reach a human representative or request that automated messages stop; and
• do not impersonate any person, business, or brand other than your own.

bijnis.xyz's Social-to-WhatsApp Funnel feature, if enabled, routes qualifying Instagram DMs or Facebook Page messages to your WhatsApp Business number. You are responsible for ensuring that end customers whose messages are routed in this way have provided valid consent to receive WhatsApp communications in accordance with Section 4.1 of these Terms.

4A.4 Social Commerce — Catalog Sync

When you use Social Commerce Sync to connect your bijnis.xyz product catalog to Instagram Shopping or Facebook Shops, you represent and warrant that:

• all product information, pricing, images, and descriptions in your catalog are accurate, current, and compliant with Meta's Commerce Policies;
• you hold all necessary rights to sell the products listed, including any intellectual property rights in product images and descriptions;
• your products and services comply with Meta's Commerce Eligibility Requirements and do not fall within prohibited product categories; and
• you will keep catalog data up to date, including prices and availability, and promptly update it through bijnis.xyz to avoid fulfillment issues.

bijnis.xyz is not responsible for Meta's approval or rejection of your catalog, individual products, or shop, nor for any enforcement action Meta takes against your Commerce account.

4A.5 Meta Policy Compliance

By using our Facebook and Instagram features, you agree to comply with and be bound by the following policies, as updated by Meta from time to time:

• Meta Business Terms of Service
• Meta Platform Terms
• Facebook Community Standards
• Instagram Community Guidelines
• Meta Commerce Policies (if using Social Commerce Sync)

It is your responsibility to remain informed of the current versions of these policies. bijnis.xyz is not responsible for changes to Meta's policies that affect your ability to use Facebook or Instagram features.

4A.6 Meta's Right to Restrict Accounts

Meta independently enforces its platform policies and reserves the right to suspend, restrict, or permanently disable any Facebook Page, Instagram account, Commerce account, or associated business assets at its sole discretion. bijnis.xyz has no control over Meta's enforcement decisions and accepts no liability for any restriction, suspension, or ban of your Facebook or Instagram assets by Meta.

You bear full responsibility for enforcement actions taken by Meta resulting from your content, practices, or violation of Meta's policies.

4A.7 bijnis.xyz's Right to Suspend Social Features

bijnis.xyz reserves the right to immediately suspend or permanently terminate your access to Facebook and Instagram integration features, without prior notice or refund, if:

• we receive a complaint, policy violation notice, or enforcement action from Meta regarding your Page or account;
• your content or use violates Section 4A.2 or any applicable Meta policy; or
• your Facebook Page or Instagram account is suspended, restricted, or disabled by Meta.

4A.8 Revoking Access

You may revoke bijnis.xyz's access to your Facebook Page and Instagram account at any time through Meta's Business Manager settings or from within your bijnis.xyz account. Upon revocation, all Facebook and Instagram automation and publishing features will cease to function immediately.

bijnis.xyz connects to YouTube channels via Google's YouTube Data API v3 to provide video publishing, community management, and analytics features. By enabling YouTube integration on our platform, you agree to the terms in this section, Google's Terms of Service, and YouTube's Terms of Service and Community Guidelines.

4B.1 Customer Authorization

By connecting your YouTube channel to bijnis.xyz, you represent and warrant that:

• you are the lawful owner or authorized manager of the YouTube channel you connect;
• you have full authority to authorize bijnis.xyz to upload videos, publish Community Posts, manage comments, and read analytics on that channel on your behalf; and
• your use of bijnis.xyz's YouTube features will comply with YouTube's Terms of Service, YouTube's Community Guidelines, and Google's Terms of Service.

4B.2 Acceptable Use — Content Publishing

You agree not to use bijnis.xyz's YouTube publishing features to upload or publish:

• content that violates YouTube's Community Guidelines, Google's Terms of Service, or applicable Indian or international law;
• content containing hate speech, graphic violence, harassment, or content that endangers minors;
• spam, misleading metadata, or artificially repeated content intended to manipulate YouTube's recommendation systems;
• content that infringes the copyright, trademark, or other intellectual property rights of any third party — you are solely responsible for ensuring you hold all necessary rights to content uploaded through our platform; or
• content in categories prohibited under YouTube's advertiser-friendly content guidelines, where applicable to your use case.

4B.3 API Quota Limitations

YouTube's Data API v3 operates under a daily quota system. bijnis.xyz manages quota allocation across all connected merchant channels on a best-effort basis. In periods of high platform demand, certain publishing or analytics operations may be delayed. bijnis.xyz is not liable for delays or failures caused by YouTube API quota limits or Google-imposed rate restrictions.

For high-volume use cases, you may request a dedicated quota increase by contacting us at hello@sotlabs.net. bijnis.xyz will use reasonable efforts to obtain additional quota from Google but cannot guarantee approval.

4B.4 YouTube Policy Compliance

By using our YouTube features, you agree to comply with and be bound by the following policies, as updated by Google and YouTube from time to time:

• YouTube Terms of Service
• YouTube Community Guidelines
• Google Terms of Service
• Google API Services User Data Policy

4B.5 Google's Right to Restrict Channels

Google and YouTube independently enforce their platform policies and reserve the right to suspend, restrict, or permanently terminate any YouTube channel or associated Google account at their sole discretion. bijnis.xyz has no control over Google's or YouTube's enforcement decisions and accepts no liability for any restriction, suspension, or termination of your YouTube channel.

bijnis.xyz does not guarantee approval of any Google OAuth verification request, API scope, or continued availability of YouTube API features.

4B.6 Content Ownership and Responsibility

You retain full ownership of all video content, Community Posts, and other material uploaded or published to your YouTube channel through bijnis.xyz. You are solely responsible for the accuracy, legality, and compliance of all content published through our platform, including ensuring you hold the necessary rights, licences, and permissions for all video, audio, imagery, and text components.

4B.7 Revoking Access

You may revoke bijnis.xyz's access to your YouTube channel at any time by visiting Google Account Permissions and removing our application, or from within your bijnis.xyz account settings. Upon revocation, all YouTube publishing and analytics features will cease to function immediately. Revoking access does not delete content already published to your channel; you must manage existing content directly through YouTube Studio.

• All subscriptions are billed in advance for a 31-day cycle. There is no auto-renewal — each cycle requires an explicit payment.
• Add-on subscriptions are aligned with the primary plan's billing cycle. The first cycle of any add-on is pro-rated against the days remaining in the active primary cycle.
• Payments made in India are processed in Indian Rupees (INR) by Cashfree (Cashfree Payments India Private Limited); international payments are processed in US Dollars (USD) by PayPal (PayPal Holdings, Inc.), on our behalf. By making a payment you also accept the applicable terms of the relevant payment processor.
• For INR payments we accept UPI, Net Banking, credit/debit cards, and NEFT — subject to the methods supported by Cashfree at the time of payment. International payments are made in USD via PayPal. Any refund is returned through the original gateway — Cashfree for INR payments and PayPal for USD payments.
• GST is charged as applicable under Indian law. Where bijnis.xyz is GST-registered, an 18% GST is added to the listed price; an applicable GSTIN you provide is included on the invoice. Where bijnis.xyz is below the registration threshold, no GST is charged.
• A GST-compliant invoice (or non-GST invoice, as applicable) is issued for every payment and emailed to you. Invoices are also accessible from the Billing page within your account.
• Sequentially-numbered invoices are immutable once issued. Adjustments are made via separately-numbered credit notes as required by Indian GST law.
• Disputed invoices must be raised within 14 days of the invoice date.

6.1 Subscription Cycles and Renewals

• All bijnis.xyz subscriptions (primary plans and add-ons) are billed on a 31-day cycle. There is no auto-renewal — each cycle requires an explicit payment.
• To continue service, you must complete payment for the next cycle on or before the expiry date of the current cycle. If you do not pay, your subscription ends automatically at the end of the current cycle.
• Add-on subscriptions are aligned to the primary plan's billing cycle. The first cycle of any add-on is pro-rated against the days remaining in the active primary cycle.
• Plan upgrades and downgrades (between Seed, Sapling, and Tree) are available only at renewal time. Mid-cycle plan changes are not supported.
• Add-ons may be added mid-cycle subject to a minimum 5 days remaining in the active primary cycle. Add-ons cannot be cancelled mid-cycle; to stop, leave them unchecked at the next renewal.

6.2 No Cancellation Action Required

• There is no separate cancellation step. To stop your subscription, simply do not renew at the next billing cycle.
• Service continues uninterrupted until the end of the cycle you have already paid for.
• Refunds for unused portions of a paid cycle are not provided, except as described under our Refund Policy.

6.2 Termination by bijnis.xyz

• We may suspend or terminate your account immediately for: non-payment, violation of these Terms, abusive behaviour toward our team, fraudulent use of services, or conduct that may expose us or third-party platforms to legal, compliance, reputational, or operational risk.
• If we terminate your account for cause — prohibited or illegitimate use (see Section 9), non-payment, fraud, or abuse — access ends immediately and your account, data, and website are permanently removed. Nothing can be restored, downloaded, or recovered, and no refund is due.
• If we choose to discontinue the service or close the business, we will give you at least 30 days' notice by email. During that window you can download all your data — your business data and an HTML copy that renders your website — so you can continue your business on your own. Prepaid fees are non-refundable; the 30-day window is your opportunity to retrieve your data before access ends.

6.3 Effect of Revocation or Termination of Google Access

• If your Google access is revoked, expires, becomes invalid, or is restricted by Google, we may be unable to continue some or all Google-related services.
• We are not liable for losses, delays, ranking changes, missing data, or service interruptions caused by revoked permissions, expired tokens, API restrictions, account suspensions, or changes to Google's platform.

6.4 Deleting Your Account

• You may delete your account at any time from Profile → Delete my account in the app. To protect you, deletion requires typing a confirmation phrase and entering a one-time code emailed to your account address (you may also request deletion by email — see our Data Deletion page).
• Your account is deactivated immediately on confirmation and permanently deleted after a 30-day grace period; you may reactivate within that period by logging back in. Deletion ends any active subscription with no refund, and your website will be taken offline.
• On permanent deletion we remove your personal and business data, but retain invoices and tax records for the period required by law (about 7 years), anonymising your account record as needed to keep those records valid.

7.1 Customer Content

You retain all ownership rights to content you provide (business name, logo, photos, text). You grant bijnis.xyz a non-exclusive, royalty-free licence to use your content solely to provide the services described herein.

7.2 bijnis.xyz Content

Website templates, code, tools, and other proprietary materials created by bijnis.xyz remain our intellectual property. Upon full payment of subscription fees, you receive a non-transferable licence to use the website we build for you as long as your subscription is active.

Non-renewal of a paid plan does not delete your website — your free website stays live and paid features simply pause; there is no data export on plan expiry. A downloadable copy of your data (your business data plus an HTML copy that renders your website) is available only when you delete your account (Section 6.4) or if we discontinue the service (Section 6.2) — not on plan expiry. Website templates and code remain the intellectual property of bijnis.xyz; the business content you supplied (logo, photos, text) remains yours.

To provide our services, we may process customer data, business profile data, account access data, and related business information, including data obtained through Google OAuth and Google APIs.

We may use such data only for legitimate service-related purposes, including:

• setting up, optimizing, or managing your business presence;
• publishing or updating approved listing content;
• responding to reviews where instructed or enabled by you;
• generating reports, analytics, and performance summaries;
• maintaining, securing, troubleshooting, and improving our services; and
• complying with legal obligations and enforcing these Terms.

We do not acquire ownership of your Google Business Profile data merely because we process it on your behalf.

We do not sell Google user data obtained through Google APIs.

Additional details regarding collection, processing, retention, deletion, and protection of personal and business-related data are set out in our Privacy Policy.

8.1 Merchant Responsibility

You are solely responsible for the accuracy, legality, and appropriateness of all business information, content, media, offers, descriptions, and instructions provided to us for use on Google Business Profile or other third-party platforms.

8.2 Deletion and Disconnection

If you disconnect your Google account, revoke our access, or terminate your subscription, certain connected features may stop working immediately.

We may retain limited records, logs, backups, invoices, support records, audit trails, and legally required business records for a reasonable period in accordance with our Privacy Policy, legal obligations, and legitimate business needs.

8.3 Google API Services User Data Policy Compliance

bijnis.xyz's use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

Without limiting the foregoing, we will use Google-derived data only:

• to provide, maintain, and improve user-facing features and services requested or enabled by you;
• to secure, troubleshoot, and monitor the proper functioning of our services;
• to comply with applicable law, regulation, legal process, or enforceable governmental request; and
• as otherwise permitted by Google's applicable policies and your instructions.

We do not sell Google user data. We do not use Google user data obtained through Google APIs for unrelated advertising, data brokering, or any purpose prohibited by Google's policies.

8.4 User-Controlled Consent and Authorization

Where required, access to Google services is granted by the end user or merchant directly through Google's own OAuth consent flow and authorization mechanisms.

You acknowledge that:

• Google may display a merchant consent dialog or related authorization screens before access is granted;
• Google may notify the account owner when third-party access is granted, changed, or revoked; and
• continued access to Google Business Profile data depends on valid user authorization, available permissions, and Google's platform rules.

8.5 No Indirect or Unauthorized Access

bijnis.xyz does not provide third parties with indirect, shared, or unauthorized access to our Google API project, credentials, or Business Profile API access.

Where Google requires direct merchant or end-user authorization, such authorization must be completed by the relevant user through Google's approved consent mechanisms.

8.6 Token Storage and Security

If OAuth access tokens, refresh tokens, or related credentials are stored by bijnis.xyz in connection with Google integrations, such credentials will be stored using reasonable administrative, technical, and organizational safeguards designed to protect them from unauthorized access, disclosure, alteration, or misuse.

We will not knowingly expose client secrets, refresh tokens, or access tokens in public-facing code, client-side source code, or any insecure manner prohibited by applicable Google policies.

8.7 Revocation, Deletion, and Retention

You may request deletion of Google-derived data or disconnection of Google account access by contacting us at hello@sotlabs.net.

Upon a valid deletion or disconnection request, we will take reasonable steps to delete or de-identify Google-derived data under our control that is no longer required for:

• providing active services requested by you;
• security, fraud prevention, and abuse prevention;
• backup and disaster recovery processes;
• compliance with legal, tax, accounting, audit, or regulatory obligations; or
• establishment, exercise, or defence of legal claims.

Where applicable, OAuth tokens and related Google access credentials will be revoked, deleted, or rendered unusable when no longer required for the authorized service or after access is revoked, subject to technical and legal constraints.

Limited data may remain in backups, logs, invoices, support records, and legally required business records for a reasonable period consistent with our Privacy Policy and applicable law.

bijnis.xyz does not allow websites or accounts for adult or escort services, drugs or controlled substances, weapons, hate or violent content, child sexual abuse material, or anything illegal. All content is checked before it goes live. Any such account is automatically taken down and permanently blocked without warning or refund, and may be reported to the relevant authorities; nothing can be restored or downloaded after such a block.

You agree not to use our services to:

• Violate any applicable Indian or international laws.
• Publish false, misleading, defamatory, or fraudulent business information.
• Infringe the intellectual property rights of any third party.
• Distribute malware, spam, or engage in phishing activities.
• Impersonate another business or individual.
• Operate in industries prohibited under Indian law (illegal gambling, unlicensed financial services, etc.).
• Violate Google's Terms of Service, Google API Services policies, or Google Business Profile policies.
• Violate Meta's Business Terms of Service, WhatsApp's Business Messaging Policy, Meta's Platform Terms, Facebook's Community Standards, Instagram's Community Guidelines, or Meta's Commerce Policies.
• Violate YouTube's Terms of Service, YouTube's Community Guidelines, or Google's Terms of Service or API policies.
• Create, request, or promote fake listings, duplicate listings, misleading location information, fake reviews, incentivized reviews in violation of policy, or deceptive review-response practices.
• Send unsolicited WhatsApp messages to contacts who have not provided valid opt-in consent.
• Publish content on Instagram, Facebook, or YouTube that infringes third-party intellectual property rights or violates applicable law.
• List products on Instagram Shopping or Facebook Shops that violate Meta's Commerce Eligibility Requirements or that you do not have the right to sell.
• Ask us to circumvent Google's, YouTube's, or Meta's verification, moderation, suspension, reinstatement, or enforcement systems.

Violation of this section may result in immediate termination without refund and may be reported to relevant authorities or relevant platform operators.

For customers on the Sapling and Tree plans who meet the eligibility conditions, bijnis.xyz offers a 90-Day Ranking Guarantee: if your business does not reach the top 5 of the Google Map Pack / Google Maps results for your agreed Primary Keyword, measured from your business location, within the Guarantee Period, and upon a valid claim raised by you by email to hello@sotlabs.net within 15 days of the end of the Guarantee Period, we will provide you 90 days of free subscription on the same plan, during which we continue working to improve your ranking. The free subscription is delivered as renewal discount coupons — three 100%-discount monthly coupons for monthly plans, or a single 25%-discount coupon for annual plans — as described in our Refund Policy. This 90-day free subscription is the sole and exclusive remedy. It is not a cash refund.

The Guarantee applies only once your Google Business Profile is verified and live on Google Maps. Google alone controls verification and its timing, which can range from a few days to several weeks, and Google may decline to verify a profile. Getting your Google Business Profile verified is your responsibility as the business owner; if Google does not verify it, our ranking services and this Guarantee do not apply.

The Guarantee applies to eligible subscribers who: complete onboarding within 5 days of signup; select and save a single geo-specific Primary Keyword during business setup (which is locked for the Guarantee Period); collect at least 10 genuine Google reviews every 30 days (a minimum of 30 over 90 days); and do not make unapproved changes to their core business details. 10.1 No Guarantee of Specific Results

While we work diligently to improve your online visibility, search engine rankings are determined by Google's algorithms, which are outside our control. We do not guarantee specific ranking positions, traffic volumes, or revenue outcomes beyond the 90-Day Ranking Guarantee described above.

We do not guarantee approval of any Google OAuth verification request, Google API access request, Google Business Profile API request, Business Profile verification request, reinstatement request, or any other Google review, approval, or moderation process.

We do not guarantee continuous availability of WhatsApp automation features, any specific message delivery rates, or that Meta will maintain our Tech Provider status or approve any specific use case.

We do not guarantee continuous availability of Facebook or Instagram publishing, engagement, or analytics features, approval of catalog submissions to Instagram Shopping or Facebook Shops, or that Meta will approve or maintain our access to any specific Graph API permission or feature.

We do not guarantee continuous availability of YouTube publishing, community, or analytics features, approval of any Google OAuth scope verification request, API access request, or continued YouTube API quota allocation at any specific level.

10.2 Limitation of Liability

To the maximum extent permitted by Indian law, bijnis.xyz's total liability to you for any claim arising from or related to these Terms or our services shall not exceed the total amount paid by you to bijnis.xyz in the 3 months preceding the claim.

We are not liable for indirect, incidental, special, or consequential damages, including lost profits, loss of business, loss of goodwill, loss of rankings, account suspension, third-party platform penalties, WhatsApp number bans, loss of WhatsApp contacts or message history, Facebook Page or Instagram account restrictions or bans, YouTube channel strikes or terminations, loss of social media content or follower data, catalog rejection or de-listing by Meta, or loss of data.

10.3 Third-Party Services

We use third-party platforms including Google, YouTube, Meta, WhatsApp, Facebook, Instagram, Meta Commerce Manager, payment providers, hosting providers, and others. We are not responsible for changes to their platforms, APIs, policies, approval standards, downtime, rate limits, quota restrictions, enforcement actions, or any other changes that may affect our ability to deliver services.

10.4 No Guarantee of Google, YouTube, or Meta Approval or Continued Access

In addition to the foregoing disclaimers, bijnis.xyz does not guarantee:

• approval of any Google OAuth consent screen, app verification request, API scope verification request, or security review;
• approval of access to the Google Business Profile API, YouTube Data API, YouTube Analytics API, or any related Google API;
• continued availability of any Google or YouTube API, OAuth scope, consent screen configuration, feature, quota, or integration pathway;
• that any Google account, Business Profile, YouTube channel, listing, or connected asset will remain verified, approved, active, or unrestricted;
• approval or continued availability of any Meta Graph API permission, Instagram Graph API permission, or Marketing API access;
• approval, continued listing, or visibility of any product catalog or product submitted to Instagram Shopping or Facebook Shops;
• continued approval of bijnis.xyz as a Meta Tech Provider, WhatsApp Business Solution Provider, or Instagram Platform Partner; or
• that any WhatsApp Business number, Facebook Page, Instagram account, or YouTube channel operated through our platform will remain active, unrestricted, or free from enforcement action by Meta or Google.

You agree to indemnify and hold harmless bijnis.xyz, SOT Labs, and their officers, directors, and employees from any claims, losses, or damages (including legal fees) arising from: (a) your use of our services, (b) content you provide to us or publish through our platform, (c) your violation of these Terms, (d) your violation of any applicable law, (e) your violation of Google's or YouTube's policies or your lack of authority to grant us access to any Google account, Google Business Profile, or YouTube channel, (f) your violation of Meta's policies, WhatsApp's Business Messaging Policy, Facebook's Community Standards, Instagram's Community Guidelines, or Meta's Commerce Policies, including enforcement actions taken by Meta against your WhatsApp number, Facebook Page, Instagram account, or Commerce account as a result of your content or practices, or (g) any third-party intellectual property claim arising from content you publish through our platform on Instagram, Facebook, or YouTube.

These Terms are governed by the laws of India. Any dispute arising out of or related to these Terms shall first be attempted to be resolved through good-faith negotiation within 30 days.

If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Jaipur, Rajasthan. The language of arbitration shall be English.

You agree that the courts at Jaipur, Rajasthan shall have exclusive jurisdiction for any matters not subject to arbitration.

We may modify these Terms at any time. We will provide at least 14 days' notice to existing subscribers before material changes take effect (via email or WhatsApp). Your continued use of our services after notice constitutes acceptance of the updated Terms.

• Entire agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and bijnis.xyz.
• Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
• No waiver: Our failure to enforce any provision is not a waiver of that provision.
• Assignment: You may not assign your rights under these Terms without our written consent. We may assign ours as part of a business transfer.

If our access to or use of Google-derived or WhatsApp-derived data changes in a material way, we may update our Privacy Policy and, where required, seek additional consent before accessing or using such data for the updated purpose.
